4. User Types and Accounts

4.1 Student Accounts

Student accounts are for individual learners who want to improve their German language skills. Students can access exercises, track progress, and take tests created by teachers.

4.2 Teacher Accounts

Teacher accounts allow educators to create custom tests, invite students, and view student results. Teachers are responsible for appropriate use of student data and compliance with applicable education laws.

5. Free Trial and Paid Access

5.1 Free Trial

• New students receive a free trial period (typically 7 days)
• No credit card required for the free trial
• Full access to all features during the trial period

5.2 Paid Access (Students)

• Student package pricing is set by the Apple App Store and Google Play and may vary by platform, region, currency, taxes, and store policies.
• Purchased access is delivered immediately after successful payment confirmation.
• Access from multiple purchases can be combined by extending the access end date.
• Because a free trial is provided and digital access is granted immediately, purchases are non-refundable except where required by applicable law.

5.3 Teacher Pricing

• Teacher plans are one-time payments with no recurring fees
• Plans include specific test creation limits (10, 30, or 100 tests)
• Teacher plan payments are non-refundable

Mobile In-App Purchases (Consumables)

The mobile app offers one-time consumable products that extend account access. These products are not subscriptions and do not auto-renew.

Payment processing for mobile app purchases is handled by Apple App Store and Google Play. We do not collect or store full card/payment credentials.

• Premium 1 Month: extends premium access by 1 month.
• Premium 3 Months: extends premium access by 3 months.
• Premium 6 Months: extends premium access by 6 months.
• Access from multiple purchases can be combined by extending the access end date.
• Because a free trial is provided and digital access is granted immediately, purchases are non-refundable except where required by applicable law.

6. Acceptable Use Policy

You agree not to:

• Use the platform for any illegal purpose or in violation of any laws
• Harass, abuse, or harm other users
• Reverse engineer, decompile, or disassemble any part of the platform
• Scrape, copy, or download content for commercial purposes
• Interfere with or disrupt the platform's operation
• Resell or redistribute access to the platform
• Share your account credentials with others
• Upload viruses, malware, or malicious code

7. الملكية الفكرية

All content, exercises, materials, and software on DeutschÜben are owned by us and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

We grant you a limited, non-exclusive, non-transferable license to access and use the platform for personal or educational purposes in accordance with these Terms.

8. User-Generated Content

For teachers who create custom tests: You retain ownership of your test content. By creating tests on our platform, you grant us a license to host, store, and display this content as necessary to provide our services. You represent that you have the right to upload any content you provide.

9. Teacher Responsibilities

• Ensure all test content is appropriate and educationally sound
• Handle student data responsibly and in compliance with privacy laws
• Comply with applicable education regulations (e.g., FERPA, COPPA)
• We do not guarantee student outcomes or exam success

10. Disclaimers

DeutschÜben is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We do not guarantee:

• The accuracy, completeness, or reliability of any content
• Uninterrupted or error-free service
• Specific learning outcomes or exam success
• Third-party services (e.g., Stripe, Google Analytics)

11. Limitation of Liability

To the maximum extent permitted by law, DeutschÜben and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the platform. Our total liability shall not exceed the amount you paid us in the past 12 months.

12. Indemnification

You agree to indemnify and hold harmless DeutschÜben and its operators from any claims, damages, losses, or expenses (including legal fees) arising from your use of the platform, violation of these Terms, or infringement of any rights of another person.

13. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time through your profile settings. Upon termination, your right to use the platform will immediately cease, though certain provisions of these Terms will survive termination.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our platform. Your continued use after such changes constitutes acceptance of the new Terms.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of Germany. Any disputes arising from these Terms or your use of DeutschÜben shall be resolved in the courts of Germany.
